The terms for using this site and working with us.

These terms cover the use of thermin-ai.com and, at a general level, the services Thermin AI provides. Services for a specific client are governed by the service agreement that client signs, which controls where it differs from this page.

Services

Depending on the agreement, our services can include:

• Ad management: building and running ad campaigns, reporting on spend, leads, and booked jobs.
• Speed to lead: automated text and voice follow-up so new leads get contacted quickly.
• 24/7 AI voice receptionist and conversational texting: answering inbound calls and carrying on two-way text conversations, with jobs booked into the client's calendar.
• Custom websites: designing and building conversion-focused websites.
• Google Business Profile optimization: improving visibility in local search.
• AIEO (AI engine optimization): improving how a company appears when customers search through AI tools.
• Reputation management: requesting reviews after jobs and flagging reviews of 3 stars or below so the client can resolve them.
• Data reactivation: re-engaging past customers and old leads.

Acceptable use of this site

You may browse this site and contact us through it. You agree not to:

• Use the site or its content for any unlawful purpose.
• Copy, scrape, or republish the site's content without permission.
• Interfere with the site's operation, attempt to breach its security, or overload it.
• Submit false information through any form, or submit another person's contact information without their permission.

Client responsibilities

• Provide accurate business information, including services, pricing, and service area, so the system answers and books correctly.
• Maintain any consent and telemarketing compliance required for the customer lists you ask us to contact. Texting or calling customers without proper consent is the client's responsibility.
• Provide the access we need to set up the system, such as phone lines, calendars, and ad accounts, when the agreement calls for it.

Payment and retainers

Services are sold under a service agreement. In general:

• Fees are billed monthly, on the schedule in the agreement.
• Ad campaigns involve advertising spend paid to the ad platform, which is separate from our fees. That spend amount is set in the agreement or in the ad account itself.
• Late payments may pause service until the account is current.
• Refunds, cancellations, and notice periods follow the signed agreement.

Third-party platforms

Our services rely on third-party platforms such as Google, Meta, telephony carriers, and messaging providers. Those platforms have their own terms, and their policies or outages can affect results. We are not responsible for actions taken by third-party platforms.

No guarantee of specific results

We work to the standards in the service agreement. Marketing outcomes depend on many factors outside our control, including market conditions, seasonality, competition, and the client's own operations. We do not guarantee specific lead volumes, booked job counts, or revenue figures.

Intellectual property

The content, design, and code of this site belong to Thermin AI. Materials the client provides, such as logos and copy, remain the client's property. Work product created for a client under an agreement belongs to the client as stated in that agreement.

Limitation of liability

To the maximum extent permitted by law, Thermin AI is not liable for indirect, incidental, special, or consequential damages, including lost profits or lost revenue. Our total liability for any claim related to the services is limited to the fees the client paid to us in the three months before the event giving rise to the claim. This limit does not apply where the law does not allow it.

Termination

Either party may end the service relationship as provided in the service agreement. On termination, the client remains responsible for fees accrued through the end of the notice period, and we will hand over access and assets per the agreement.

Governing law

Governing law and venue for disputes are set in the service agreement.

Changes to these terms

We may update these terms as our services change. The latest version is always on this page, with the date it was last updated.
